Welcome to Oz Festive Events. These Terms of Service govern your use of our website and our entertainment services. By accessing our website or engaging our services, you agree to be bound by these terms.

1. Our Services

Oz Festive Events provides event entertainment services including but not limited to:

  • Poker table entertainment
  • Blackjack table entertainment
  • Roulette entertainment
  • Dice game entertainment
  • Event styling and theming
  • Professional hosting services

All entertainment services operate with fun money or chips only. No real-money wagering is involved in any of our entertainment offerings.

2. Booking and Payment

Booking Process

Bookings are confirmed upon:

  • Receipt of a completed booking agreement
  • Payment of the required deposit
  • Written confirmation from Oz Festive Events

Deposits

A deposit is required to secure your event date. Deposit amounts are specified in your quote and typically range from 20-30% of the total service fee. Deposits are non-refundable except in circumstances where Oz Festive Events cancels the booking.

Final Payment

Final payment is due 7-14 days prior to the event date, as specified in your booking agreement. Failure to pay by the due date may result in cancellation of your booking without refund of deposit.

Pricing

All prices are quoted in Australian Dollars (AUD) and are exclusive of GST unless otherwise stated. Prices are valid for 30 days from the date of quotation. Travel charges may apply for events outside metropolitan areas.

3. Client Responsibilities

As the client, you agree to:

  • Provide accurate and complete information about your event requirements
  • Ensure the venue can accommodate the entertainment setup
  • Provide safe access for equipment setup and removal
  • Obtain any necessary permissions from the venue
  • Ensure adequate lighting and climate control at the entertainment area
  • Supervise guest behaviour during entertainment
  • Inform us of any venue-specific requirements or restrictions

4. Cancellation and Rescheduling

Cancellation by Client

Cancellation fees apply as follows:

  • More than 30 days before event: Full refund less deposit and 10% administration fee
  • 14-30 days before event: 50% refund of total fees
  • 7-14 days before event: 25% refund of total fees
  • Less than 7 days before event: No refund

Cancellation by Oz Festive Events

In the unlikely event that Oz Festive Events must cancel your booking, you will receive a full refund of all payments made, including the deposit. We will make reasonable efforts to provide alternative arrangements or reschedule where possible.

Rescheduling

Rescheduling requests are subject to availability. More than 30 days' notice typically allows rescheduling without penalty. Rescheduling within 30 days may incur fees equivalent to cancellation policies outlined above.

5. Liability and Indemnity

Limitation of Liability

Oz Festive Events provides entertainment services in good faith. To the fullest extent permitted by law, our liability is limited to:

  • The total amount paid for the specific service in question
  • Direct damages only (excluding indirect, consequential, or special damages)

Client Indemnity

You agree to indemnify Oz Festive Events against any claims, losses, damages, or expenses arising from:

  • Guest behaviour during the event
  • Misrepresentation of event requirements or venue conditions
  • Breach of these Terms of Service
  • Failure to obtain necessary venue permissions

6. Intellectual Property

All content on this website, including text, images, logos, and design elements, is owned by Oz Festive Events and protected by copyright laws. You may not reproduce, distribute, or create derivative works without our express written permission.

7. Website Use

You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit the use and enjoyment of the site by any third party. Prohibited activities include but are not limited to:

  • Attempting to gain unauthorised access to our systems
  • Interfering with website functionality or security
  • Using automated tools to scrape or harvest data
  • Transmitting viruses or malicious code

8. Privacy

Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using our services, you consent to such data practices.

9. Force Majeure

Oz Festive Events is not liable for failure to perform due to circumstances beyond our reasonable control, including but not limited to natural disasters, government restrictions, travel disruptions, or venue access issues. In such cases, we will work with you to reschedule or provide alternative arrangements.

10. Amendments

We reserve the right to amend these Terms of Service at any time. Amendments will be posted on this website with an updated "Last Updated" date. Your continued use of our services following amendments constitutes acceptance of the revised terms.

11. Governing Law

These Terms of Service are governed by the laws of New South Wales, Australia. Any disputes arising from these terms or our services will be subject to the exclusive jurisdiction of the courts of New South Wales.

12. Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining terms remain in full force and effect.

13. Entire Agreement

These Terms of Service, together with any applicable booking agreement and Privacy Policy, constitute the entire agreement between you and Oz Festive Events regarding the use of our services and supersedes any prior agreements or communications.
